CNN —When the Supreme Court left for its summer recess in June, the justices were at a stalemate on adopting a formal ethics code. Chief Justice John Roberts has been seeking unanimity among the nine justices for firm ethics standards, CNN has learned, but such agreement has eluded him. He told the WSJ writers that he was speaking out to defend himself and the Supreme Court because “nobody else” would. “Even assuming that trip is somehow relevant to present concerns about Supreme Court ethics, the connection is highly attenuated, focused on ‘an object remote’ from purported ‘legitimate concerns’ about ethics standards,” Rivkin wrote. A separate Associated Press investigation recently focused on liberal Justice Sonia Sotomayor’s use of Supreme Court staff to coordinate and promote the sale of her books.

A new AP report details how Sonia Sotomayor's book sales intertwine with her service as a Justice. "250 books is definitely not enough," one aide told a public library in Oregon. The report found that taxpayer-funded staff at the Supreme Court have often pressured public institutions, including colleges and libraries, to purchase more of Sotomayor's books for events around the country where the liberal justice has been invited to speak. But because Supreme Court has no formal code of ethics, such practices are legal. While Republicans have generally defended these arrangements, Democrats have seized on the revelations to call for instituting a formal code of ethics at the Supreme Court.

Rep. Alexandria Ocasio-Cortez floated a possible subpoena for Chief Justice John Roberts. Roberts has declined to testify before the Senate about ethical issues surrounding the court. "And so I believe that ... if Chief John Roberts will not come before Congress for an investigation voluntarily, I believe that we should be considering subpoenas," Ocasio-Cortez told CNN's Dana Bash on "State of the Nation" on Sunday. "This SCOTUS' corruption undercuts its own legitimacy by putting its rulings up for sale," Ocasio-Cortez wrote on Twitter after the decision. While Republicans control the House, Ocasio-Cortez pointed out that Senate Democrats are investigating the numerous reports about unreported gifts to the justices through the powerful Senate Judiciary Committee.

Skop and 10 other doctors submitted their testimony when the case began in November. She said she was harmed by the FDA expanding access to the pill because she has treated dozens of women at her hospital's emergency room with mifepristone complications. Erin Hawley, an attorney with the Alliance Defending Freedom legal organization representing the plaintiffs, said abortion sets the case apart. In the abortion pill case, the two initial court rulings found harm to Skop and other doctors was "impending" because the mifepristone label says the treatment may be unsuccessful in up 7% of women.

In June 2022, Justice Samuel Alito's wife leased a plot of land in Oklahoma to an oil and gas company. Alito in several rulings before the court has been part of majority decisions to reduce the scope of the EPA. There are thousands of oil and gas leases across Oklahoma, where the energy sector is a critical economic driver. But the oil and gas lease troubles many environmentalists given Justice Alito's role in weakening the scope of the Environmental Protection Agency in several cases that have come before the court. And last year, the Supreme Court in West Virginia v. Environmental Protection Agency limited the federal agency's ability to control the level of carbon emissions from power plants.

In exchange for as little as a few thousand dollars in contributions to the nonprofit, these people received easy access to events where Supreme Court justices would be. Supreme Court Historical society trustee Jay Sekulow, center, represented President Trump during the latter's impeachment trial in 2020. Anti-abortion advocates cheer in front of the Supreme Court after the decision in Burwell v. Hobby Lobby Stores was announced in 2014. Alito did not respond to a request for comment on his involvement in the Supreme Court Historical Society. Supreme Court justices, though, aren't even required to stay within those weak guardrails because no code of ethics governs justices' behavior.
